Terms & Conditions – Alaris

These Terms and Conditions govern the contractual relationship between Kölbl Korbinian and Medicus Theresa Pia GbR, trading under the name “Alaris”, Trivastraße 9, 80638 Munich, Germany (hereinafter referred to as “Alaris”), and clients who use Alaris’ bespoke travel planning and travel brokerage services. Alaris is not a tour operator, but acts solely as an intermediary for travel services provided by third-party suppliers.
1. Scope of Services and Contractual Relationship

Alaris arranges premium travel experiences on behalf of its clients, including hotels, resorts, villas, chalets, flights, transfers, experiences, visa assistance, and concierge services.
All travel services are provided by third-party suppliers (e.g. hotels, airlines, agencies, visa services).
Contracts for the provision of such travel services are concluded exclusively between the client and the respective supplier.
Alaris assumes no liability for the proper fulfilment, availability, pricing, or performance of the services provided by third parties.
2. Commitment Fee / Planning Fee
Alaris charges a Commitment Fee (Planning Fee) for its bespoke travel planning service.
This fee covers the cost of consultation, research, and mediation and becomes due prior to commencement of planning.
The amount of the fee depends on the scope of work and will be communicated to the client in advance – verbally, by phone, or in writing.
The Commitment Fee is non-refundable, even if no booking is made.
It is not credited towards future services.
Upon payment of the Commitment Fee, the client authorises Alaris to begin the individual planning process.
3. Bookings, Payments, and Tax Information

Alaris acts exclusively as an intermediary.
All payments for travel services are made directly between the client and the respective supplier.
The applicable payment and cancellation terms are determined solely by each supplier.
Alaris may submit booking requests or act on behalf of the client but assumes no responsibility for acceptance or rate guarantees from suppliers.
All invoices issued by Alaris include the legally required VAT and VAT identification number.
For cross-border B2B services within the EU, invoices are issued under the reverse charge mechanism (Art. 196 EU VAT Directive) where applicable.
Any fees for international bank transfers are borne by the payer.
4. Partnerships and Preferential Rates

Alaris collaborates with a curated selection of hotels, travel providers, and brands.
Through these partnerships, Alaris may obtain exclusive rates, upgrades, or special benefits, which may be passed on to clients.
Such partnerships do not establish Alaris as a tour operator.
Contracts and payments are concluded solely between the client and the respective hotel or provider.
Alaris accepts no liability for the execution, quality, or availability of any third-party service.
5. Compensation and Commissions
​
Alaris may receive commissions or referral fees from hotels or partners for its mediation and recommendations.
These commissions have no influence on the selection or recommendation of properties.
No additional cost arises for the client.
Commissions are due only after the client’s payment to the supplier has been received.
6. Liability for Mediated Services
​
Alaris’ liability is limited to the proper execution of its mediation services as contractually agreed.
Alaris is not the organiser of any travel service and bears no responsibility for the delivery or quality of those services.
Alaris assumes no liability for disruptions, changes, cancellations, deficiencies, or other breaches of duty caused by third-party suppliers (e.g. hotels, airlines, agencies, transport companies, or visa services).
Any claims relating to the provision of travel services must be made directly to the respective supplier.
Alaris is not liable for events beyond its control, including force majeure, strikes, political unrest, natural disasters, pandemics, governmental measures, flight cancellations, rate changes, or other unforeseen circumstances.
7. Cancellations

In the event of a cancellation, the supplier’s cancellation policy exclusively applies.
Alaris has no influence over these terms and does not provide separate cancellation rules.
Planning fees already paid are non-refundable.
Commissions are payable only once the booked services have been fully completed and paid for.
8. Travel Insurance
​
Alaris strongly recommends that all clients obtain appropriate travel insurance, including trip cancellation, curtailment, and international health coverage.
The arrangement and verification of insurance coverage are the client’s responsibility.
Alaris accepts no liability for any loss resulting from insufficient or missing insurance coverage.
9. Credit Card and Payment Data
​
In the course of travel arrangements, Alaris may enter credit card details into the booking systems of partners (e.g. Myler).
Storage and processing of this data are handled exclusively by the respective payment service provider (e.g. Stripe).
Stripe is a PCI DSS Level 1 certified payment provider.
Credit card data is encrypted and tokenised directly by Stripe.
Alaris itself does not store any credit card numbers or security codes and has no further access to full card details once entered.
Stripe processes all data solely for payment purposes in compliance with European data protection standards.
10. Communication
​
Communication between Alaris and clients may take place via email, telephone, WhatsApp, or other digital means.
By engaging with Alaris, the client agrees to receive documents and correspondence electronically.
11. Social Media Collaborations / Sponsored Content
​
For paid promotional services (e.g. Instagram posts, stories, or other collaborations), the following terms apply:

50 % deposit upon confirmation, balance due within 7 days of publication.

If a sponsor cancels prior to publication, the deposit remains as a non-refundable handling fee.

Should Alaris fail to deliver, the deposit will be refunded or an alternative post will be offered.

Published content remains the property of Alaris; usage rights by the partner require separate written agreement.

Alaris reserves the right to decline collaborations that do not align with the brand’s identity or ethical standards.

Once published, the content may remain visible on the official Alaris and luxuryhotelsworld channels for up to 12 months, unless otherwise agreed.
12. Data Protection
​
Alaris processes personal data strictly in accordance with applicable data protection laws.

13. Governing Law and Jurisdiction
​
These Terms are governed exclusively by German law.
The place of jurisdiction is Munich, Germany.
For international clients, German law likewise applies.
Should any provision of these Terms be or become invalid, the remaining provisions shall remain in full force and effect.
